Limited Warranty and Returns Policy

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHER LEGAL RIGHTS, WHICH VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). NATURAL CYCLES DOES NOT EXCLUDE, LIMIT, OR SUSPEND OTHER LEGAL RIGHTS YOU MAY HAVE UNDER THE LAWS OF YOUR STATE (OR COUNTRY OR PROVINCE) THAT CANNOT BE LAWFULLY LIMITED BY THIS LIMITED WARRANTY. 

1.1 Limited Warranty and Warranty Period.

During the limited warranty period for each Product set forth below (“Limited Warranty Period”), Natural Cycles provides a limited warranty for any such Products with defects in materials or workmanship, subject to the exclusions set forth in Section 1.2 below.

NC° Band	Natural Cycles warrants to the original purchaser that any new Natural Cycles product will be free from defects in materials and workmanship for one (1) year from the date of purchase. In regions where local laws provide a longer warranty period, we will honor the longer period required by your country’s regulations when reviewing your claim, as permitted.
NC° Basal Thermometer	Natural Cycles does not provide a Limited Warranty with respect to any NC° Basal Thermometers that are provided to you as a marketing gift (see Section 12.10 of the Terms). For any NC° Basal Thermometers purchased through our Webshop or provided in connection with your purchase of our Services, we provide a two (2) year replacement warranty.
Repaired or Replaced Products	The later of ninety (90) days following Natural Cycles’ repair or replacement of such Product, or the end of such Product’s original Limited Warranty Period.

1.2 Warranty Claims.

Before seeking warranty service, please access and review the online help resources available at our Support Center or review the Cyclerpedia “Shipping” webpage for information. If you still have unresolved issues after making use of these resources, please submit a warranty claim by following the instructions provided to you through our Support Center (such claim, a “Warranty Claim”). 

Please see Section 3 below for information about how we process and handle Warranty Claims.

1.3 Limited Warranty Exclusions.

The limited warranty set forth in Section 1.1 above does not apply to, and Natural Cycles does not provide a warranty for Products with: (a) cosmetic damage, such as scratches, nicks and dents; (b) damage for wear and tear expected to occur during the normal course of use; (c) damage of or issues with consumable parts, such as batteries, unless damage to the Product has occurred due to a defect in materials or workmanship; (d) damage caused by accident, abuse, mishandling, misuse, water, flood, fire, or other acts of nature or external causes; (e) damage arising from use in violation of any applicable standard, code, and/or instructions for use and installation, including, but not limited to, those contained in the instruction manual provided with the covered Product when purchased; (f) damage caused by exposure of the covered Product to temperatures, humidity, water, or other environments outside of the recommended ranges or environments. Natural Cycles reserves the right to refuse Warranty Claims against Products that are obtained or used in contravention of the laws of any country; or (g) damage to a product that has been connected to power and/or data cables that are not supplied by Natural Cycles. 

1.4 Disclaimer.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WARRANTIES AND REMEDIES CONTAINED IN THIS LIMITED WARRANTY ARE EXCLUSIVE AND IN LIEU OF, AND NATURAL CYCLES EXPRESSLY DISCLAIMS, ALL OTHER WARRANTIES AND REMEDIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, STATUTORY REMEDY OR OTHERWISE. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS, WHICH VARY FROM STATE TO STATE AND FROM COUNTRY TO COUNTRY.

IF IMPLIED WARRANTIES CANNOT BE DISCLAIMED UNDER THE LAWS OF YOUR STATE OR COUNTRY, THEN SUCH WARRANTIES ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY. SOME STATES (AND COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

IN NO EVENT WILL NATURAL CYCLES BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING WHETHER RESULTING FROM THE USE MISUSE OR INABILITY TO USE A PRODUCT OR FROM DEFECTS IN THE PRODUCT. SOME STATES (AND COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

2.1 Return Terms. 

You may return the Products identified below (“Returned Product”) during the return periods for such Products (“Return Periods”) by submitting a return claim (each, a “Returns Claim”) through our Support Center.  If eligible for a return, a pre-paid return label will be provided electronically to return the item.

2.2 Conditions for Returns.

To be eligible for a return, a Returned Product must be shipped to us in the condition set for in the table above in Section 2.1. For NC° Basal Thermometers returns, the seal on the shipper box cannot be broken. After the Return Period expires for the applicable Product, we cannot offer you a refund or an exchange unless such Product is covered by a Limited Warranty for such Product.

2.3  Return Exclusions.

Notwithstanding the foregoing, we reserve the right to refuse to accept returns of or issue a refund, in whole or in part, for Products in the cases listed below (“Return Exclusions”): 

• Products purchased from third-party retailers, such as pharmacies. Such Products are subject to that retailer’s return policies, and Natural Cycles disclaims any liability with respect to the return of such Products;
• Products consisting of intimate or sanitary goods, or which are not returnable for health or hygiene reasons (including menstrual products, condoms, vibrators, etc.);
• Products consisting of perishable goods, such as ovulation tests and pregnancy tests;
• Products returned by any person other than: (a) the original purchaser of the Product or (b) a subsequent owner who can provide the original order number applicable to the initial purchase of the Product;
• Products returned from outside of the Territory where the Product was originally shipped to by Natural Cycles;
• Products obtained or used in contravention of the laws of any country;
• Products that are not in their original condition with all original packaging and unbroken seals, or which Natural Cycles is otherwise not able to assess because such Products were not returned to Natural Cycles successfully, or in an acceptable state; or

Products that were provided to you as a marketing gift pursuant to Section 13.9 of the Terms.

2.4  Restocking Fee.

You are responsible for a restocking fee of $10 U.S. dollars for any Returned Products (“Restocking Fee”) unless we determine that the Returned Products were defective before they were delivered to you. The Restocking Fee will be deducted from your final, approved refund. The Restocking Fee may be updated from time to time, including based on region.

3.1 Shipping.

To return a Product subject to a Warranty Claim or Return Claim, please ship the item, including the receipt or proof of purchase, by using the pre-paid return label provided in our response to the Warranty Claim or Return Claim. The item should be packaged by you in such a way that no damage can occur during transit. Unless prohibited by law, any shipping and handling charges paid for the original purchase of a Product will not be refunded.

3.2 Information Regarding Claim.

In connection with your Warranty Claim or Return Claim, you may be asked to provide, amongst other information: (a) your name, address, email address and telephone number; (b) a copy of your receipt, bill of sale or other comparable proof of purchase for the Product being returned or that you are requesting warranty service for; and (c) with respect to any Products covered by the Limited Warranty, information relating to the Product’s defect or flaw. Verification of information may be required prior to the acknowledgment of any Warranty Claim or Return Claim. 

3.3 Inspection of Products.

Following receipt of your Warranty Claim or Return Claim submitted with all requested by Natural Cycles (including the information in Section 3.2 above), and return of the Products subject to such Warranty Claim or Return Claim, Natural Cycles will inspect the Products and notify you if we have accepted or rejected the Warranty Claim or Return Claim. 

3.4 Acceptance or Rejection of Claim.

Return Claims.  If we accept the Return Claim, we will issue a refund to the original payment method used to purchase the Returned Product for the amount of the original purchase price including any associated sales tax, but with the Restocking Fee deducted from such amount. 

Warranty Claims. If we accept a Warranty Claim during the Limited Warranty Period, then Natural Cycles will, at its option: (a) repair the device using new parts or previously used parts that satisfy Natural Cycles’ quality standards; (b) replace the device with a new device or a Natural Cycles recertified device that meets Natural Cycles’ quality standards; or (c) exchange the device for a full refund of your purchase price. Any such repairs or replacement will be made at no charge to you  for parts or labor

Rejected Claims. If we reject a Warranty Claim or Return Claim (including for reasons set forth in Section 1.3 or Section 2.3 above), we are not required to refund you for the affected Product or repair or replace the Product. 

Gifts and Gift Certificates.  For items given or received as a gift, Natural Cycles is only able to issue a refund to the payment method used by the original purchaser. We do not offer gift certificates or credits.
